De geheven belasting ziet op het bedrag dat een eindgebruiker bij aanschaf voor een goed of een dienst betaalt. De belasting drukt op (particuliere) consumenten en verder ook op andere eindverbruikers, maar wordt geheven bij de ondernemers die de goederen leveren of de diensten verrichten.<\/p>\n<p>Omdat de omzetbelasting wordt geheven volgens het bestemmingslandbeginsel, betekent dit dat als u ondernemer bent en goederen levert aan of diensten verricht voor Nederlandse eindverbruikers, u voor de omzetbelasting belastingplichtig bent. Het is echter mogelijk dat de verleggingsregeling van toepassing is voor u.<\/p>\n<p>In het geval u niet in Nederland woont, of uw onderneming is niet in Nederland gevestigd en u heeft ook geen vaste inrichting in Nederland waarvanuit de dienst wordt verricht en degene aan wie u de dienst verricht een Nederlandse BTW-identificatienummer heeft, kan de heffing worden verlegd naar de afnemer.<\/p>\n<p><span id=\"result_box\" class=\"\" lang=\"nl\"><span class=\"\">Hiertoe dient een kwalificerende factuur door de leverancier te worden opgesteld.<\/span> <span class=\"\">Als deze factuur niet voldoet aan specifieke voorwaarden, is de verleggingsregeling mogelijk niet van toepassing, wat tot een schadevergoeding voor de leverancier kan leiden.<\/span> <span class=\"\">We kunnen u een voorbeeld van een kwalificerende factuur toezenden. Een voorbeeldfactuur kunt u per <em><strong><span style=\"color: #ff6600;\"><a style=\"color: #ff6600;\" href=\"\/?page_id=5513\">e-mail<\/a><\/span><\/strong><\/em> bij ons opvragen.<\/span><\/span><\/p>\n<p>Het tarief van de omzetbelasting is 21%, dit tarief geldt echter niet voor alle goederen en diensten. Op sommige goederen en diensten wordt er een verlaagd tarief van 9% geheven of zij worden volledig van heffing vrijgesteld. Verder wordt de omzetbelasting geheven volgens het zogenoemde principe van belasting over de toegevoegde waarde met aftrek van voorbelasting.<\/p>\n<p>De belastingplichtige moet in beginsel:<\/p>\n<ul>\n<li>Op eigen initiatief een aangifte voor omzetbelasting doen en deze ook betalen over de vergoedingen die hij heeft ontvangen voor het leveren van een goed of het verrichten van een dienst;<\/li>\n<li>Op het door de belastingplichtige te betalen bedrag brengt belastingplichtige vervolgens de aan hem in rekening gebrachte of door hem verschuldigde belasting voor de aan hem verrichte leveringen van goederen en aan hem verleende diensten in mindering;<\/li>\n<li>De uitkomst leidt tot een te betalen of te ontvangen bedrag aan omzetbelasting.
